City of Miami Planning Department Launches Initiative to Update Miami 21 Public Benefits Program Market Rate Fees

The City of Miami Planning Department has launched a major initiative to review and update the Miami 21 Public Benefits Program Market Rate Fees—an effort that will modernize the program and ensure it reflects current market conditions and community needs.

Background

The City of Miami’s Public Benefits Program, established under Section 3.14 of the Miami 21 Zoning Code, enables developers to obtain additional floor lot ratio (FLR) and bonus stories through cash contributions to eligible public programs or through local neighborhood enhancements. The fees paid by developers are collected for the Public Benefits Program and placed into a Public Benefits Trust Fund (Sec. 62-641) for use of Affordable Housing, Parks and Open Spaces and Green Building. 

The contributions are calculated based on Market Rate Fees, which are determined using a square footage multiplier assigned to each market area within the City. These multipliers have not been adjusted to reflect market conditions in more than a decade, and a result, they no longer align with comparable incentive programs—such as the Wynwood NRD-1 multiplier—and no longer reflect the City’s current economic landscape. 

Thus, The City is undergoing a review of the Public Benefits Market Rate Fees with a professional consultant to ensure the rates are appropriate for the current economy. 

Scope of Work

The consulting group will examine the current economic landscape and evaluate the below to update the Public Benefits Program Market Rate Fees:

  • Developing updated square footage multipliers for each market area of the City to support the Public Benefits Program, ensuring equitable and market‑responsive contributions for additional floor area and bonus stories.
  • Enhancing or replacing the current fee methodology, using a data‑driven approach that can be updated regularly based on information readily available to the City.
  • Analyzing current market rates for residential, commercial, and industrial properties, including trends influenced by economic shifts, demographic patterns, and regulatory changes.
  • Calculating revised Public Benefits Fees for different sectors of the City, including areas delineated by the Miami 21 East Quadrant and other relevant sub‑sectors.
